WebAIM Million 2021 revealed that 97.4% of the top 1 million home pages had detectable WCAG 2 errors (not warnings). They found that 40% of home pages had skipping heading levels; developers aren't exactly great at picking the right tool for the job, not even the developers of the most popular sites.

Of course, the developer usually does not do this out of malice, but rather to profit more at the users' expense. That does not make it any less nasty or more legitimate.
