The existence or absence of independent legal advice is also relevant. However, the absence of actual legal advice does not automatically make a Release invalid. The question is whether the surrounding circumstances reasonably show that the complainant did not have a meaningful opportunity to obtain advice, did not understand the nature of the Release, or did not voluntarily agree to it.
