    1. Ironically, like Roger Taney’s opining in Dred Scott, it first raises its head in a “headnote” to a case not dealing with the issue. In remarks setting the scene for their decision in Santa Clara County v. Southern Pacific Railroad (1886), the court remarked, “The court does not wish to hear argument on the question whether the provision in the Fourteenth Amendment to the Constitution, which forbids a State to deny to any person within its jurisdiction the equal protection of the laws, applies to these corporations. We are all of the opinion that it does.” This statement, that the court were “all of the opinion” that “any person” applied to the fictional entities created by state charters, precluded any formal challenge by telegraphing the outcome. Thus, in a sneaky way, the court avoided having to actually produce a decision of an actual case to establish this principle. Talk about legislating from the bench!

      He can "feel comfortable" all he wants, but his feelings are where the subject ends.

      Simply having opinions does not grant anyone authority to impose those opinions on others - especially when one is of the tyrannical opinion that engaging in an activity that one disapproves of is enough to deprive that person of the human right to self-defense outright.

      Maybe they're aware of how dangerous it is, so now they're still doing it, but being more careful about it - resulting in the significant drop in incidents that OSP is reporting locally.

    1. Hopefully, Sonoma County supervisors will consider placing a road repair bond on the ballot during a high turnout election, such as the November 2016 presidential election.

      What, if anything, can citizens to to force the hand of the Supervisors to put a bond forward?<br> Because if the quotes and soundbytes hold any truth, the Board members intend to tow the gunshy company line towards being more aggressive about specific funding - and of course they might - because if it isn't part of the General Fund, they have little ability to exercise their discretion on how it is used. I see this as a great thing.
