    2. How you track student progress can make a difference in their learning and your teaching.

I will have to develop my own assessment strategies - formative and summative.

    1. Performance assessment does not have to be a time-consuming ordeal; it is a great way to assess our students' skills. It is essential to create a rubric that is simple, quick, and objective. This article discusses the process of creating a rubric as well as showing a rubric used by the author in her general music classroom for several years. Differences between assessment and evaluation are also mentioned.

How to create a rubric for performance assessment?

    1. It is interesting to notice that this article from a decade ago doesn't even mention any online assessment. So much has changed since then! I'm glad to see that from measuring attendance and attitude we are moving toward a more professionally acceptable system where we can teach, assign and assess measurable knowledge in music ed, more specifically in choral programs.

    2. 11% for music knowledge

Only 11% for knowledge! That is surprising and could be more if we don't try to measure "talent" but the knowledge that is teachable and factual. Again, this is old data (1991) so today the numbers might look different.

    3. attendance and attitude were the most common grading criteria employed by instrumental and choral music teachers.

Yes. I noticed that in schools.

I have been trying to avoid the word "money" in my annotations to avoid coming off as anti-capitalist as I really am, but yes: Corporations do not give a care about individuals or marginalized groups outside of how they can profit off of their oppression. Remember this June; this Pride Month; that any company selling you rainbow merchandise is not doing it out of legitimate care about LGBTQ+ rights but because it's profitable! Yes, even if they're giving 20% of proceeds to charity - where do you think the other 80% goes?

    1. Field Engineer Story

First field engineer in the field of telecommunications and networks:

Telecommunication engineering has seen immense advances in the recent years and thus, the role of a field engineer has also evolved. Telecommunication engineering is among the most evolving industries in the world. It is a branch of electrical engineering and it dates back to the 18th century when there were beacons and telegraphs used for communication.

The first field engineer in the field of telecommunications and networks was Claude Chappe, who was a French engineer. Then we have a long list of field engineers such as Thomas Edison, Carlos Slim, and many more. After the advent of computer networks and the internet in the 20th century, the role of a field engineer completely changed.

Who created the first telecom company that offers a link between consumer and employees?

The telecom industry is expected to expand even more in the coming years, but to date, the world's top telecommunication companies have reached a market value of over $50 billion. China Mobile Ltd., Verizon Communications Inc., and AT&T Inc. are the leaders in the world of telecommunication service providers. These companies serve as a link between the consumer and the employees, allowing them to communicate whether they're using traditional wired telephones or mobile phones.

We created the FE On Demand Freelance Marketplace Platform to streamline engagement between field engineers and businesses looking for them.

    1. alid or invalid on a priori ground*y Thus, de-pending on the problem, the laboratory may bean altogether appropriate setting for an investiga-tion and certain real-life environments may behighly inappropriate. Suppose, for example, oneis interested in studying the interaction betweenmother and child when the child is placed in astrange and unfamiliar situation. Clearly the lab-oratory approximates this condition far better thanthe home. Conversely, if the focus of inquiry isthe modal pattern of parent-child activity pre-vailing in the family, observations confined to thelaboratory can be misleading. As I have docu-mented elsewhere in greater detail (Bronfenbren-ner, in press), patterns of parent-child interactionin the laboratory are substantially and systemati-cally different than those in the home. Specifi-cally, so far as young children are concerned, theresults indicate that the strangeness of the labora-tory situation tends to increase anxiety and othernegative feeling states and to decrease manifesta-tions of social competence (Lamb, 1976b; Ross,Kagan, Zelazo, & Kotelchuck, 1975; Lamb, Note3). Possibly in response to this reaction of thechild, parents tend to exhibit more positive inter-i actions toward their children in the laboratory' than in the home (Schlieper, 1975; Shalock, 1956;Belsky, Note 4). In addition, Lamb (1976b;Note 3) reported that the tendency of the infantat home to display more affiliative behaviors (e.g.,looking, smiling, reaching, vocalizing) toward thefather than the mother was reversed in the labora-tory. Moreover, consistent with the arguments ofSroufe (1970) and Tulkin (1972) that the lab-oratory is especially likely to be an anxiety-arous-ing situation for lower-class families, Lamb foundsocioeconomic differences in father-infant inter-action favoring the middle class in the laboratory,'whereas such differences had not been present inI the h o m e.Again, the fact that

Since my Action Research is based on building relationships with the families from Room 3, I was interested to see the impact of laboratory research vs. home environment research. According to this paragraph, it is hard to get a clear picture of parent-child relationship in either setting due to a number of factors. If I understand it correctly, however the laboratory environment is less optimal to infants, young children and families of lower socio-economic status. Increased anxiety was cited as a contributing factor. I believe that the Hawthorne Effect could contribute to the difference is how parents responded positively to their children in the laboratory versus at home. So far, of the homes I have visited this semester, there is not a significant amount of difference between how the children are interacted with at school, compared to how they are interacted with at home. It will be interesting to see, based on what I've read in this paper, if what I have experienced recently will be evident with all of the families. I also wonder, if age and familiarity are factors? I work with one-year-olds and they have all developed a secure relationship, over time, with me, unlike the people who conducted this research. Any thoughts from others, is greatly appreciated, regarding whether or not you too experience what the article says or what I have experienced.

    1. The music we listen to highly impacts our decision making, especially as adolescents. Adolescents are extremely impressionable, and the music they listen to has a great impact on how they decide to live their day to day lives. Popular musicians are seen as role models by the people who idolize them, and adolescents may try to represents the songs in which they favor through their actions every day.

Recent studies have found that adolescents who listen to music that supports substance abuse and violence have a greater chance to act upon what they listen to. What young adults and teenagers listen to through music and popular media will affect their decision making process. Specifically with substance abuse, and there is a direct uptake in use of illegal substances by adolescents who listen to music that promotes such activities. This can cause a whole societal problem considering most of todays popular music among adolescents touches upon substance abuse and violence. Adolescents are extremely impressionable and the music they listen can shape how a person tries to act, or represent themselves.

    1. being able to wear clothing that enabled better mobility. Walker chose to wear what was known as the "Bloomer costume" as a modified uniform all throughout the war. It was a dress-and-trouser combination that had gone out of favor long before the war began, but she didn't care -- she wore it anyway.

From the time she was a girl she wore pants and she continued to do so even in the military.

    2. In 1863, her medical credentials were finally accepted, so she moved to Tennessee, where she was appointed as a War Department surgeon

The phrasing of this appears to be somewhat biased. It sounds like her credentials weren't up to snuff or something but really, the military was low on surgeons at that time and simply didn't want a woman. https://hyp.is/vAWzXCtjEem5j1tLLCQ8dg/cfmedicine.nlm.nih.gov/physicians/biography_325.html

    3. Because of her credentials, she didn't want to be a nurse, either, so she chose to volunteer for the Union Army.

This is some what conflicting information. According to https://hyp.is/vAWzXCtjEem5j1tLLCQ8dg/cfmedicine.nlm.nih.gov/physicians/biography_325.html she did work as a Nurse, she just wasn't paid.

    4. Walker went into private practice for a few years, but then the Civil War broke out in 1861. She wanted to join the Army as a surgeon but wasn't allowed because she was a woman.

She was a surgeon in private practice but wanted to join the war effort.

She finally was appointed a surgeon near the end of the war.

    2. Dr. Mary Walker was an outspoken advocate for women's rights, and the first woman ever awarded the Congressional Medal of Honor.

She wore her medal everyday and also modified her uniform in the war to have pants. In 1917 they took all medals of honor away for anyone who hadn't been "in combat". She refused to give her medal up and wore it until the day she died. Jimmy Carter later reinstated her medal in 1977.

    3. At the outbreak of the Civil War, she volunteered in Washington to join the Union effort, and worked as a nurse in a temporary hospital set up in the capital.

She worked as an unpaid nurse because she was not allowed to join as a surgeon in the US military.

We also subscribe to a view of reflection as a fully engaged interaction and not a detached assessment. Finally, we draw from the observation that reflection is often triggered by an element of surprise, where someone moves from knowing-in-action, operating within the status quo, to reflection-in-action, puzzling out what to do next or why the status quo has been disrupted

Influences from reflection-in-action for reflective design values/methods.

    2. In this effort, reflection-in-action provides a ground for uniting theory and practice; whereas theory presents a view of the world in general principles and abstract problem spaces, practice involves both building within these generalities and breaking them down.

Cheap car insurance will result in being cost effective at the time of accident. This will give you the satisfaction of driving a car with the support of adequate car insurance.

    1. Initial resistance to the hospitalist movement among physicians often focused on the unavoidable discontinuity in care created by the model and the potential loss of information across the hospital threshold.45,49-52 Effective hospitalist programs have created mechanisms to mitigate the impact of this discontinuity, including calling primary care physicians on admission and discharge, faxing daily progress notes, and encouraging primary care physicians to visit or call their hospitalized patients. Though some concerns about information transfer linger, 2 recent surveys suggest that most physicians now accept the hospitalist model. In a national telephone survey of 400 internists, 51% (204) thought hospitalists might provide better care and 46% (184) thought patients might get more cost-effective care. Although 73% were concerned about the impact of hospitalists on continuity, physicians with hospitalists in their community were more approving.10 In a survey of 524 California primary care physicians, physicians perceived hospitalists as increasing (41%) or not changing (44%) the overall quality of care and most (55%) thought that hospitalists increase inpatient efficiency.11 In both surveys, primary care physicians stated their belief that patients generally preferred to be cared for in the hospital by their regular physician. Surveys of both generalists and specialists at Park Nicollet showed high levels of physician satisfaction several years after the implementation of a hospitalist program.28
    2. A major early concern was that patients accustomed to having their primary physician as their inpatient attending would not accept hospitalists.45 In general, however, surveys of patients who were cared for by hospitalists show high levels of satisfaction, no lower than that of similar patients cared for by their own primary physicians28,31,32 or by traditional academic ward attendings.18,21 We have postulated that patients may be willing to trade off the familiarity of their regular physician for the availability of the hospitalist.45
    1. “The day is upon us where we need to strongly consider nurse practitioners and physician assistants as equal in the field,” he says. “We’re going to find a much better continuity of care for all our patients at various institutions with hospital medicine and … a nurse practitioner who is at the top of their license.”

Hospitalists as QB should play leadership role in integrating all members of care team

    2. “The role of the hospitalist often is to take recommendations from a lot of different specialties and come up with the best plan for the patient,” says Tejal Gandhi, MD, MPH, CPPS, president and CEO of the National Patient Safety Foundation. “They’re the true patient advocate who is getting the cardiologist’s opinion, the rheumatologist’s opinion, and the surgeon’s opinion, and they come up with the best plan for the patient.”
    1. 2.1.1 Cognitive and psycholinguistic theories of SLA One of the main theoretical frameworks on the cognitive side is the input–interactionist paradigm (Long, 1996), and the early research on online interaction in FL/SL contexts focused on the development of linguistic competence in in-class interaction, e.g., comparing online synchronous interaction with face-to-face student interaction. Many of these studies used a quantitative methodology, involving control groups of students engaged in face-to-face interaction that were compared to experimental groups of learners participating in online interaction or intra-class studies in which the same students took part in both face-to-face and online interaction (Warschauer, 1996b). What was often counted and categorized were linguistic features and language functions (e.g., Chun, 1994; Kern, 1995), and researchers showed how negotiation for meaning occurs in intra-class online chat (e.g., Blake, 2000). Similarly, studies of online interaction based on psycholinguistic theories of SLA (e.g., Ellis’ (2006) Associative Cognitive CREED and Schmidt’s (1990) Noticing Hypothesis) have found that text-based chat promotes noticing of grammatical and lexical features or errors (e.g., Lai & Zhao, 2006; Lee, 2008). Other studies of interclass interactions between learners and native speakers (Tudini, 2003) or tandem learning partnerships (Kötter, 2003; O’Rourke, 2005) have investigated form-focused interaction, negotiation of meaning and code switching, primarily linguistic aspects of SL/FL learning.

    1. The results of the paired-groups experimental study proves "are interpreted as being supportive for the interactionist perspective on SLA, especially the importance of attention". The study focuses on the acquisition of lexical meaning through negotiated interaction on NNS-NNS synchronous CMC. Check into Long's Interaction Hypothesis.

    1. The Interaction Approach and CMC (Bryan Smith): The Interaction Approach(IA) in second language acquisition studies suggests that there is a link between interaction and learning. This approach focuses on three major components of interaction — exposure (input), production (output), and feedback. Many CALL researchers have adopted this theoretical perspective in exploring the relationship between CMC and instructed second language acquisition, exploiting many of the argued affordances offered by this medium in relation to the key tenets of the IA. This paper will provide a conceptual overview of the IA and explore specifically how CALL researchers have sought to study SLA from this theoretical perspective. We will discuss several methodological hurdles facing researchers engaged in this type of research and will offer some suggested strategies for conducting sound SLA/CALL research from an IA.

the interaction approach overlaps with psycholinguistic approach under the cognitive theory

    2. Psycholinguistics, SLA, and Technology (Scott Payne): Investigating second language acquisition and CALL from a psycholinguistic perspective entails examining how language learners process, store, and retrieve information from memory and how cognitive capacity impacts acquisition and influences performance. This paper will provide an overview of psycholinguistic approaches to SLA research highlighting research findings relevant to the field of CALL. This discussion will include some of the challenges and opportunities for researchers interested in employing psycholinguistic methods for studying SLA in classroom and computer-mediated contexts.

    1. Despite the hospitalist field’s unprecedented growth, there have been challenges. The model is based on the premise that the benefits of inpatient specializa-tion and full-time hospital pres-ence outweigh the disadvantages of a purposeful discontinuity of care. Although hospitalists have been leaders in developing sys-tems (e.g., handoff protocols and post-discharge phone calls to pa-tients) to mitigate harm from dis-continuity, it remains the model’s Achilles’ heel.
    2. The field’s rapid growth has both ref lected and contributed to the evolution of clinical practice over the past two decades.
    1. As with anymajor transition, the medical community must con-tinually reevaluate the new approach to ensure thatany possible discontinuity in care is outweighed byimproved clinical outcomes, lower costs, better edu-cation for physicians, and greater satisfaction on thepart of patients.
    1. Duffy points to the increase in health care interactions online and adds that he would like to see a pervasive culture of in-person care as last resort. “If every organizational decision, technology decision, process decision — assuming all the payment stuff, that’s kind of ticket of entry, transpires — if you view in-person as last resort, that will help pull systems across the country to a more consumer-forward Uber-like experience,” he says

    1. That makes this challenge a lot harder to resolve than if we had tried a century ago

But even if we had tried a century ago, would it have mattered? The article just stated that "we'd have gotten segregated cities anyways because of behavior that's beyond the reach of regulation."

    2. racial preferences still shape where people choose to live today.

      Fear of what is different?

    3. behavior that's beyond the reach of regulation

Good way of explaining why we still see segregation in our communities

    6. "we would still have very segregated cities, because a certain number whites were unwilling to live with blacks."

Segregation is still present today. A great example of this is the segregation and disparities we see in inner city public schools.

    7. Shertzer and Walsh are pointing to another set of factors — not the policies of institutions, but the behavior of individuals.

Racist behaviors. But I do not see how this is novel information? This time period is teeming with examples of racist behavior not motivated by institutional policies.

    8. That makes this earlier form of white flight even more striking; their new homes didn't necessarily have lower taxes or better school districts, factors that complicated the motivations of later generations of whites.

OK... so this era of White flight is striking because they were leaving for purely racist motivations. Not because there were also better reasons to move out of the city (lower taxes, better schools).

    9. "Whites left the neighborhood as a result of blacks arriving," Shertzer says, "not for other reasons."

So... racism? Is that what they are considering a "casual" reason for leaving?

    10. As blacks arrived in northern neighborhoods, more whites left.

I can understand why White people were able to move from neighborhoods. However, how were cities legally able to keep African Americans from moving in to certain neighborhoods?

    11. relevant to American cities that are still racially divided today

Which cities? I think the cities that are racially divided today would be similar to the ones that were segregated in the past (Chicago, New York, Detroit).

    12. "White flight" is usually described as a post-World War II phenomenon

I wonder why "White flight" is typically associated with this time period? I think I remember learning about a GI Bill that encouraged this once the soldiers returned home from war.

    1. Traditional education is failing to engage many students as they enter their middle school, high school, and college years. The culture clash between formal education and interest-driven, out-of-school learning is escalating in today’s world where social communication and interactive content is always at our fingertips. We need to harness these new technologies for learning rather than distraction.

I agree with this. As the work load becomes more demanding, students tend to be too overwhelmed and lose interest in the content and material.

I was well acquainted with a well-off old man, And his place of dwelling was down in the glen He was well propertied, with plenty of livestock, And silver and gold to go along with it

He took the advice that he should marry a young woman, As she’d look after his house much better than he, But by morning and night she was cross and upset, About the key to the trunk which was not to be found

Isn’t it a pitiful case, that you’d approach any woman, When you know in your heart you couldn’t be loved, Amn’t I kind to you, that you’d ever be so lucky, That I’d stay by your side you crooked old wretch

Didn’t I give you much, silver and gold, Small boats and big ones, a horse and cart, Your fill of fine things, and of good hearty good, A fine bed of feathers, where you sleep at your ease

If you gave me the world, and all it has to eat and drink, All the wealth of King George which is known to be grand, A fleet under fine sail and coaches under the road, I’d rather have a young man than you, you old wretch

If you can’t see sense, go find your young man Put on your coat, and your cloak round your neck, Be at the crossroad when evening comes, And you’ll get yourself a young man if you wait long enough

If I could find shelter somewhere in the Liberties Oh how happily I’d spend winter there It would gladden my mind, and not at all break my heart Like it does to lie with you, you old wretch

‘S í an teanga Ghaodheilge is greannta cló, Go blasta léightear í mar cheol ‘S í chanas briathra binn-ghuth beóil, ‘S is fíor gur mór a h-áille (v)

Hyde’s romantically excessively verse translates roughly as:

It is the Gaelic language whose shape is most fine, She reads as a tuneful music, It is she who sings the mouth’s sweetest syllables, And truly her beauty is great

    2. or

"I have, in the following little volume, collected a few of these, the Love-Songs of a single province merely, which I either took down in each county of Connacht from the lips of the Irish-speaking peasantry - a class which is disappearing with most alarming rapidity - or extracted from MSS, in my own possession, or from some lent to me, made by different scribes during this century, or which I came upon while examining the piles of modern manuscript Gaelic literature that have found their last resting-place on the shelves of the Royal Irish Academy." (iv)

The way Hyde makes reference to sources is casual and non-specific. It would be difficult for a reader to access his sources. Because we have such little insight, it is important to be alert to potential biases in the collecting and editing process.

If we can identify consistencies among the anthologized songs in terms of their depiction of love and lovers, and/or among songs which are excluded from the anthology, we will have reason to regard the very partial disclosure of sources with suspicion.

As I have already noted, part of Hyde’s project is to bring the reader into contact with language which has an ‘unbounded’ power to excite the Irish Muse. Perhaps part of the way he contrives this encounter is to control the kind of subject matter that will appear to the reader as that which occurs most naturally in the Irish language.

If one is familiar with the meditative system of visual holograms produced by tigle as per the Dzogchen lineage, the description shown here, where tigle is described as being productive of various impure cognitive aspects of grasping to true exsitance in terms of the Prasangkika (sgra-spyi etc.) is very interesting. The way in which tigle is interpreted and assimilated with this kind of philosophical positioning and their transforation at the level of path and result as devoid form (tong gzugs), indestructible sound (gzhom med kyi grad), non conceptual awareness and unchanging blissfull awareness culminating in the eventual 4 bodies of a Buddha (sprul-sku, longs-spyod rdzoks pai sku, ye-she chos sku and ngo wo nyid sku) which are particular to the Gelug system seems to demonstrate that there are a wide variety of approaches to these terms and practices. I am curious how interpretations have changed over time and how the various Tibetan Buddhist schools each approach the Kālacakra tantra.

What are the symptoms of newly acquired toxoplasmosis in an adult?

More than 80% of newly infected persons experience no symptoms, and are unlikely to be aware of the infection.

Symptoms may occur following an incubation period of one to two weeks after exposure and include:

      *mild fever

      *swollen glands

      *malaise

      *muscle and/or joint pain

      *headache

      *sore throat, and

      *skin rash.

*Eye symptoms may include blurred vision or floaters during active disease.

The diagnosis can be confirmed by detecting antibodies to Toxoplasma in the blood. Swelling of the liver or spleen may be noted, and in rare cases the lungs, brain, liver, or heart may be involved. The condition usually resolves without treatment within a few months.

A screencast, on the other hand, doesn’t give much of a clue as to what the user is committing to. Pictures have natural break points between steps. A series of images enhances closure, which is the phenomenon of observing the parts but perceiving the whole. Comics artists employ closure by carefully sequencing panels and knowing what to keep “off-screen.” A series of animated GIFs combines closure with the dynamic element of video.

GIFs (and their resurgence) are an interesting hybrid approach falling somewhere between videos and images. One can see how modelling videos after animated GIFs could be a good way to provide quick, just-in-time information.

    1. 4. The best mode of government for youth in large collections, is certainly a desideratum not yet attained with us. It may well be questioned whether fear, after a certain age, is the motive to which we should have ordinary recourse. The human character is susceptible of other incitements to correct conduct, more worthy of employ, and of better effect. Pride of character, laudable ambition, & moral dispositions are innate correctives of the indiscretions of that lively age; and when strengthened by habitual appeal & exercise, have a happier effect on future character, than the degrading motive of fear; hardening them to disgrace, to corporal punishments, and servile humiliations, cannot be the best process for producing erect character. The affectionate deportment between father & son offers, in truth, the best example for that of tutor & pupil;

      Preach!

In executing their duties to organize and govern the University of Virginia, the Commissioners created 5 provisions for the education of the youth. Of interest is #4, in which the Commissioners discuss in length how best to govern the students. Wisely, they deduce that "fear" does not create men of "erect character." Instead, they believed the act of appealing to one's "pride of character" and "moral dispositions" when governing young men would better produce the desired effect. The Commission further supports their position by saying that ideally the tutor/pupil relationship should emulate the father/son relationship as the best means to motivate and govern the student body. "Fear" and "corporal punishment" are merely degrading methods of governing and should be avoided in all situations. I believe in the US education system fear is used to much for motivation and I think it is completely unproductive!

    2. Education, in like manner engrafts a new man on the native stock, & improves what in his nature was vicious & perverse, into qualities of virtue and social worth; and it cannot be but that each generation succeeding to the knowledge acquired by all those who preceded it, adding to it their own acquisitions & discoveries, and handing the mass down for successive & constant accumulation, must advance the knowledge & well-being of mankind

      Amazing Idea!

In this paragraph, the commissioners are having an intellectual conversation of the virtues of formal education. I found this quotation particularly intriguing because it explains how education improves mankind and ideally improves each individual’s natural born qualities. The idea that education can improve “virtue and social worth” is unique and seems like one of the cornerstones of the engagement series. The line “constant accumulation, must advance the knowledge & well-being of mankind” shows how we learn and improve from one generation to another as humans. This relates to other parts of the article when it states that the hope of education is that we can use the knowledge of our forefathers and expand on it. It is good to know that this idea of knowledge is engrained in the roots of the University of Virginia and is still valued today!

    1. The point of political protest is to change the world. And yet the process matters, too.
    2. To live in the present is not to avoid hard work or strife. Alongside the projects that occupy you in your profession, or in your political life, the telic activities that matter to you, is the atelic process of protesting injustice or doing your job. To value the process is not to flee from work or political engagement. That is why living in the present is not an abdication of ethical responsibility or a recipe for detachment.
    3. To live in the present is to appreciate the value of atelic activities like going for a walk, listening to music, spending time with family or friends. To engage in these activities is not to extinguish them from your life. Their value is not mortgaged to the future or consigned to the past, but realized here and now. It is to care about the process of what you are doing, not just projects you aim to complete.
    4. Atelic activities, by contrast, do not by nature come to an end and are not incomplete. In defining such activities, we could emphasize their inexhaustibility, the fact that they do not aim at terminal states. But we could also emphasize what Aristotle does: They are fully realized in the present. “At the same time, one is seeing and has seen, is understanding and has understood, is thinking and has thought.” There is nothing you need to do in order to perform an atelic activity except what you are doing right now. If what you care about is reflecting on your life or spending time with family or friends, and that is what you are doing, you are not on the way to achieving your end: You are already there.
    1. Which type of sampling is better here: with or without replacement? Justify your answer.

With replacement simply has more "bootstrapping" power than without correct? But with a large enough sample is there any other effect replacement or non-replacement has on the "outcome?" Or is the effect insignificant with large enough samples.

    1. The purpose of elevating certain rights to the stature of guaranteed fundamental rights is to insulate their exercise from the disdain of majorities, whether legislative or popular. The guarantee of constitutional rights does not depend upon their exercise being favourably regarded by majoritarian opinion. The test of popular acceptance does not furnish a valid basis to disregard rights which are conferred with the sanctity of constitutional protection

Need for fundamental rights, and statutory protection not being sufficient

    2. narrow tailoring of the regulation to meet the needs of a compelling interest

Narrow tailoring + compelling interest test

    3. The view about the absenceof a right to privacy is an isolated observation which cannot coexist with the essential determination rendered on the first aspect of the regulation. Subsequent Benches of this Court in the last five decades and more, have attempted to make coherent doctrine out of the uneasy coexistence between the first and the second parts of the decision in Kharak Singh

Kharak Singh - the observation on absence of rt to privacy an isolated one at variuance with the first part?

    4. The observation in regard to the absence of the right to privacy in our Constitution was strictly speaking, not necessary for the decision of the Court in M PSharmaand the observation itself is no more than a passing observation.

Observations on privacy in MP Sharma not part of the ratio

Provisions in these conventions which confer a protection against arbitrary and unlawful interference with a person’s privacy, family and home would, it was held, be read in a manner which harmonizes the fundamental rights contained in Articles 14, 15, 19 and 21 with India’s international obligations

    6. our considered opinion that subjecting a person to the impugned techniques in an involuntary manner violates the prescribed boundaries of privacy. Forcible interference with a person's mental processes is not provided for under any statute and it most certainly comes into conflict with the “right against self-incrimination”

    8. Also, a large number of people are non-vegetarian and they cannot be compelled to become vegetarian for a long period. What one eats is one's personal affair and it is a part of his right to privacy which is included in Article 21 of our Constitution as held by several decisions of this Court.

Hinsa Virodhak Sangh - aside from right to practise trade under 19 (1) (g), right to make one's eating choices was also invoked - example of privacy including decisional autonomy.

    10. access to bank records to the Collectordoes not permit a delegation of those powers by the Collector to a private individual. Hence even when the power to inspect and search is validly exercisable by an organ of the state, necessary safeguards would be required to ensure that the information does not travel to unauthorised private hands.

Where delegation of responsibilities, need for proper safeguards. Very relevant observation in the context of PPP models of governance and data collection/processing

privacy derived from freedoms under 19, as well life and liberty under 21

    13. Court repudiated the notion that a person who places documents with a bank would, as a result, forsake an expectation of confidentiality. In the view of the Court, even if the documents cease to be at a place other than in the custody and control of the customer, privacy attaches to persons and not places and hence the protection of privacy is not diluted

      2 important observations

      • recognition of privacy attached to persons and and not places (moving beyond a propertarian view of privacy)

      • sharing of information does not lead to forsaking a reasonable expectation of privacy. Without reference, repudiation of third party doctrine. privacy not quivalent with secrecy.

more importantly, established a woman's bodily integrity as a part of privacy

    20. observations in Malak Singhon the issue of privacy indicate that an encroachment on privacy infringes personal liberty under Article 21 and the right to the freedom of movement under Article 19(1)(d). Without specifically holding that privacy is a protected constitutional value under Article 19 or Article 21, the judgment of this Court indicates that serious encroachments on privacy impinge upon personal liberty and the freedom of movement

Malak SIngh is on lines of the view of advanced by the respondents, that some violations of privacy could infringe other recognised rights such as personal liberty under 21 or freedom of movement under 19 (1) (d)
